①한국소비자원의 업무는 다음 각 호와 같다. <개정 2020.5.19, 2020.12.29>

②한국소비자원이 제1항제5호의 규정에 따른 업무를 수행함에 있어서 다음 각 호의 사항은 그 처리대상에서 제외한다.

1. 국가 또는 지방자치단체가 제공한 물품등으로 인하여 발생한 피해구제. 다만, 대통령령으로 정하는 물품등에 관하여는 그러하지 아니하다.

③한국소비자원은 업무수행 과정에서 취득한 사실 중 소비자의 권익증진, 소비자피해의 확산 방지, 물품등의 품질향상 그 밖에 소비생활의 향상을 위하여 필요하다고 인정되는 사실은 이를 공표하여야 한다. 다만, 사업자 또는 사업자단체의 영업비밀을 보호할 필요가 있다고 인정되거나 공익상 필요하다고 인정되는 때에는 그러하지 아니하다.

④ 원장은 제1항제2호 및 제5호의 업무를 수행함에 있어서 다수의 피해가 우려되는 등 긴급하다고 인정되는 때에는 사업자로부터 필요한 최소한의 시료를 수거할 수 있다. 이 경우 그 사업자는 정당한 사유가 없는 한 이에 따라야 한다. <신설 2018.12.31>

⑤ 원장은 제4항 전단에 따라 시료를 수거한 경우 특별한 사정이 없으면 시료 수거일로부터 30일 이내에 공정거래위원회 및 관계 중앙행정기관의 장에게 그 시료수거 사실과 결과를 보고하여야 한다. <신설 2018.12.31>
