소방시설 설치 및 관리에 관한 법률 제22조(소방시설등의 자체점검)

① 특정소방대상물의 관계인은 그 대상물에 설치되어 있는 소방시설등이 이 법이나 이 법에 따른 명령 등에 적합하게 설치ㆍ관리되고 있는지에 대하여 다음 각 호의 구분에 따른 기간 내에 스스로 점검하거나 제34조에 따른 점검능력 평가를 받은 관리업자 또는 행정안전부령으로 정하는 기술자격자(이하 "관리업자등"이라 한다)로 하여금 정기적으로 점검(이하 "자체점검"이라 한다)하게 하여야 한다. 이 경우 관리업자등이 점검한 경우에는 그 점검 결과를 행정안전부령으로 정하는 바에 따라 관계인에게 제출하여야 한다.

② 자체점검의 구분 및 대상, 점검인력의 배치기준, 점검자의 자격, 점검 장비, 점검 방법 및 횟수 등 자체점검 시 준수하여야 할 사항은 행정안전부령으로 정한다.

③ 제1항에 따라 관리업자등으로 하여금 자체점검하게 하는 경우의 점검 대가는 「엔지니어링산업 진흥법」 제31조에 따른 엔지니어링사업의 대가 기준 가운데 행정안전부령으로 정하는 방식에 따라 산정한다.

④ 제3항에도 불구하고 소방청장은 소방시설등 자체점검에 대한 품질확보를 위하여 필요하다고 인정하는 경우에는 특정소방대상물의 규모, 소방시설등의 종류 및 점검인력 등에 따라 관계인이 부담하여야 할 자체점검 비용의 표준이 될 금액(이하 "표준자체점검비"라 한다)을 정하여 공표하거나 관리업자등에게 이를 소방시설등 자체점검에 관한 표준가격으로 활용하도록 권고할 수 있다.

⑤ 표준자체점검비의 공표 방법 등에 관하여 필요한 사항은 소방청장이 정하여 고시한다.

⑥ 관계인은 천재지변이나 그 밖에 대통령령으로 정하는 사유로 자체점검을 실시하기 곤란한 경우에는 대통령령으로 정하는 바에 따라 소방본부장 또는 소방서장에게 면제 또는 연기 신청을 할 수 있다. 이 경우 소방본부장 또는 소방서장은 그 면제 또는 연기 신청 승인 여부를 결정하고 그 결과를 관계인에게 알려주어야 한다.
