소방시설 설치 및 관리에 관한 법률 제23조(소방시설등의 자체점검 결과의 조치 등)

① 특정소방대상물의 관계인은 제22조제1항에 따른 자체점검 결과 소화펌프 고장 등 대통령령으로 정하는 중대위반사항(이하 이 조에서 "중대위반사항"이라 한다)이 발견된 경우에는 지체 없이 수리 등 필요한 조치를 하여야 한다.

② 관리업자등은 자체점검 결과 중대위반사항을 발견한 경우 즉시 관계인에게 알려야 한다. 이 경우 관계인은 지체 없이 수리 등 필요한 조치를 하여야 한다.

③ 특정소방대상물의 관계인은 제22조제1항에 따라 자체점검을 한 경우에는 그 점검 결과를 행정안전부령으로 정하는 바에 따라 소방시설등에 대한 수리ㆍ교체ㆍ정비에 관한 이행계획(중대위반사항에 대한 조치사항을 포함한다. 이하 이 조에서 같다)을 첨부하여 소방본부장 또는 소방서장에게 보고하여야 한다. 이 경우 소방본부장 또는 소방서장은 점검 결과 및 이행계획이 적합하지 아니하다고 인정되는 경우에는 관계인에게 보완을 요구할 수 있다.

④ 특정소방대상물의 관계인은 제3항에 따른 이행계획을 행정안전부령으로 정하는 바에 따라 기간 내에 완료하고, 소방본부장 또는 소방서장에게 이행계획 완료 결과를 보고하여야 한다. 이 경우 소방본부장 또는 소방서장은 이행계획 완료 결과가 거짓 또는 허위로 작성되었다고 판단되는 경우에는 해당 특정소방대상물을 방문하여 그 이행계획 완료 여부를 확인할 수 있다.

⑤ 제4항에도 불구하고 특정소방대상물의 관계인은 천재지변이나 그 밖에 대통령령으로 정하는 사유로 제3항에 따른 이행계획을 완료하기 곤란한 경우에는 소방본부장 또는 소방서장에게 대통령령으로 정하는 바에 따라 이행계획 완료를 연기하여 줄 것을 신청할 수 있다. 이 경우 소방본부장 또는 소방서장은 연기 신청 승인 여부를 결정하고 그 결과를 관계인에게 알려주어야 한다.

⑥ 소방본부장 또는 소방서장은 관계인이 제4항에 따라 이행계획을 완료하지 아니한 경우에는 필요한 조치의 이행을 명할 수 있고, 관계인은 이에 따라야 한다.
