보호관찰관은 가종료자 등이 가종료ㆍ치료위탁 또는 가출소 되기 전 2개월 이내에 치료명령을 집행하여야 한다. 다만, 치료감호와 형이 병과된 가종료자의 경우 집행할 잔여 형기가 있는 때에는 그 형의 집행이 종료되거나 면제되어 석방되기 전 2개월 이내에 치료명령을 집행하여야 한다.
