선박의 입항 및 출항 등에 관한 법률 제42조(선박경기 등 행사의 허가)
Act on Entry into and Departure from Ports of Vessels, etc., Article 42 (Permission for Events such as Vessel Races)
① 무역항의 수상구역등에서 선박경기 등 대통령령으로 정하는 행사를 하려는 자는 해양수산부령으로 정하는 바에 따라 관리청의 허가를 받아야 한다. <개정 2020.2.18>
(1) A person who intends to hold an event prescribed by Presidential Decree, such as a vessel race, in the water areas, etc. of a trade port shall obtain permission from the administrator, as prescribed by Ordinance of the Ministry of Oceans and Fisheries.
② 관리청은 제1항에 따른 허가 신청을 받았을 때에는 다음 각 호의 어느 하나에 해당하는 경우를 제외하고는 허가하여야 한다. <개정 2020.2.18>
(2) Upon receiving an application for permission under paragraph (1), the administrator shall grant permission, except where the application falls under any of the following:
1. 행사로 인하여 선박의 충돌ㆍ좌초ㆍ침몰 등 안전사고가 생길 우려가 있다고 판단되는 경우
1. Where it is judged that the event is likely to cause a safety accident, such as vessel collision, grounding, or sinking;
2. 행사의 장소와 시간 등이 항만운영에 지장을 줄 우려가 있는 경우
2. Where the location and time, etc. of the event are likely to hinder port operations;
3. 다른 선박의 출입 등 항행에 방해가 될 우려가 있다고 판단되는 경우
3. Where it is judged that the event is likely to obstruct the navigation of other vessels, such as entering or leaving port; or
4. 다른 선박이 화물을 싣고 내리거나 보존하는 데에 지장을 줄 우려가 있다고 판단되는 경우
4. Where it is judged that the event is likely to hinder other vessels in loading, unloading, or preserving cargo.
③ 관리청은 제1항에 따른 허가를 하였을 때에는 해양경찰청장에게 그 사실을 통보하여야 한다. <개정 2017.7.26, 2020.2.18>
(3) Upon granting permission under paragraph (1), the administrator shall notify the Commissioner of the Korea Coast Guard thereof.
