생물다양성 보전 및 이용에 관한 법률 시행령 제9조(생태계서비스지불제계약의 체결방법 등)

① 기후에너지환경부장관, 관계 중앙행정기관의 장 또는 지방자치단체의 장(이하 이 조에서 "행정기관의 장"이라 한다)이 법 제16조제1항에 따른 생태계서비스지불제계약(이하 "생태계서비스지불제계약"이라 한다)을 체결하려는 경우에는 다음 각 호의 구분에 따라 계약의 주요 내용, 대상지역, 계약기간 등 필요한 사항을 15일 이상 공고하거나 게시해야 한다. <개정 2020.6.2, 2025.10.1>

② 생태계서비스지불제계약을 체결하려는 토지의 소유자ㆍ점유자 또는 관리인은 기후에너지환경부령으로 정하는 바에 따라 생태계서비스지불제계약 청약서를 해당 행정기관의 장에게 제출해야 한다. <개정 2020.6.2, 2025.10.1>

③ 행정기관의 장은 제2항에 따라 청약서를 제출받은 경우에는 계약내용, 정당한 보상액의 지급시기ㆍ산정방법 등 필요한 사항에 대하여 청약인과 협의하여 이를 조정할 수 있으며, 그 협의ㆍ조정된 내용에 따라 청약인과 계약해야 한다. <개정 2020.6.2>

④ 기후에너지환경부장관 및 관계 중앙행정기관의 장은 생태계서비스지불제계약의 운용에 필요한 세부 사항을 정하여 특별시장, 광역시장, 특별자치시장, 도지사, 특별자치도지사에게 통보할 수 있다. <개정 2019.10.15, 2020.6.2, 2025.10.1>
