새만금사업 추진 및 지원에 관한 특별법 제36조의5(현물출자 재산의 상환)

① 국가가 제36조의4제3항에 따라 매립면허권을 현물출자하는 경우에는 국가와 공사는 현물출자한 재산과 그 대가로 취득한 주식을 출자일부터 20년 이내에 상호 상환하는 것을 조건으로 한다.

② 제1항에 따라 공사가 출자받은 재산을 상환하는 경우에는 상환시점의 시가에도 불구하고 현물출자 당시에 「국유재산법」 제62조 본문에 따라 산정한 출자가액에 상당하는 현금(현금으로 상환이 어려운 경우에는 조성토지 또는 매립면허권)으로 상환한다.

③ 제1항에 따라 국가가 취득한 주식을 반환하는 경우에는 국가는 취득한 주식을 반환시점의 시가에도 불구하고 현물출자 당시의 가격을 기준으로 반환한다.

④ 제1항부터 제3항까지에 따른 상환절차ㆍ상환방법 등에 필요한 사항은 대통령령으로 정한다.
