상호저축은행법 제23조의11(청산)

① 상호저축은행이 다음 각 호의 어느 하나에 해당하는 사유로 해산하면 금융위원회는 청산인을 선임한다.

② 청산인은 취임 후 지체 없이 상호저축은행의 재산상태를 조사하고 재산 목록과 재무상태표를 작성하여 주주총회의 승인을 받아야 한다. 청산 사무가 종결된 때의 결산보고서에 관하여도 또한 같다. <개정 2021.4.20>

③ 제2항의 경우 2회 이상의 소집에도 불구하고 주주총회가 성립되지 아니하거나 주주총회의 승인을 받지 못하면 청산인의 신청에 따른 금융위원회의 승인으로 주주총회의 승인을 받은 것으로 본다.

④ 금융위원회가 청산인을 선임한 경우에는 상호저축은행으로 하여금 보수를 지급하게 할 수 있다.

⑤ 금융위원회는 필요하면 직권으로 또는 이해관계인의 청구에 따라 청산인을 해임할 수 있다.

⑥ 상호저축은행의 청산에 관하여는 이 법에 정한 것 외에는 「상법」 중 청산에 관한 규정을 준용한다.
