산업입지 및 개발에 관한 법률 제7조의5(스마트그린산업단지의 지정 등)

① 산업단지지정권자는 제6조, 제7조 또는 제7조의2에 따라 지정한 산업단지(준공인가를 받은 산업단지는 제외하되, 부분준공된 산업단지의 경우에는 아직 준공되지 아니한 부분을 말한다. 이하 이 장에서 같다)를 스마트그린산업단지로 지정하거나 제6조, 제7조 또는 제7조의2에 따라 산업단지로 지정함과 동시에 스마트그린산업단지로 지정할 수 있다.

② 스마트그린산업단지의 지정에 관하여는 제6조, 제7조 및 제7조의2를 준용한다. 이 경우 "산업단지"는 "스마트그린산업단지"로 본다.

③ 스마트그린산업단지의 사업시행자가 산업단지개발사업에 건축사업을 포함할 경우에는 해당 건축물에 대하여 「녹색건축물 조성 지원법」 제17조에 따른 제로에너지건축물 인증을 받아 그 결과를 표시하여야 한다. 이 경우 사업시행자는 제38조제5항에도 불구하고 건축사업으로 발생한 분양수익을 국토교통부장관이 제5항에 따라 정하는 기준에 따라 스마트그린산업단지와 관련된 사업에 사용할 수 있다.

④ 스마트그린산업단지에 대통령령으로 정하는 건축물을 건축하려는 건축주는 「녹색건축물 조성 지원법」 제16조에 따른 녹색건축의 인증과 같은 법 제17조에 따른 제로에너지건축물 인증을 받아야 한다. <개정 2024.2.20>

⑤ 국토교통부장관은 스마트그린산업단지의 체계적인 조성을 위하여 스마트그린산업단지의 지정ㆍ개발에 관한 사항, 시설의 설치기준 등을 정하여 고시할 수 있다.
