산림조합법 제61조의2(합병에 따른 임원 임기에 관한 특례)

① 합병으로 설립되는 조합의 설립 당시 조합장ㆍ이사 및 감사의 임기는 제38조제1항에도 불구하고 설립등기일부터 2년으로 한다. 다만, 합병으로 소멸되는 조합의 조합장이 합병으로 설립되는 조합의 조합장으로 선출되는 경우 설립등기일 현재 조합장의 종전 임기 중 남은 임기가 2년을 초과하면 그 조합장의 임기는 그 남은 임기로 한다.

② 합병 후 존속하는 조합의 변경등기 당시 재임 중인 조합장, 이사 및 감사의 남은 임기가 변경등기일 현재 2년 미만이면 제38조제1항에도 불구하고 그 임기를 변경등기일부터 2년으로 한다.
