산림조합법 제42조(임원의 의무와 책임)

① 조합의 임원은 이 법과 이 법에 따른 명령 및 정관의 규정을 준수하여 충실히 그 직무를 수행하여야 한다.

② 임원이 그 직무를 수행할 때 법령 또는 정관을 위반한 행위를 하거나 그 임무를 게을리하여 조합에 끼친 손해에 대하여는 연대하여 손해배상의 책임을 진다.

③ 임원이 그 직무를 수행할 때 고의 또는 중대한 과실로 제3자에게 끼친 손해에 대하여는 연대하여 손해배상의 책임을 진다.

④ 제2항 및 제3항의 행위가 이사회의 의결에 따른 것일 때에는 그 의결에 찬성한 이사도 연대하여 손해배상의 책임을 진다. 이 경우 의결에 참가한 이사 중 이의를 제기한 사실이 의사록에 적혀 있지 아니한 사람은 그 의결에 찬성한 것으로 추정한다.

⑤ 임원이 거짓의 결산보고ㆍ등기 또는 공고를 하여 조합 또는 제3자에게 끼친 손해에 대하여도 제2항 및 제3항과 같다.
