산림자원의 조성 및 관리에 관한 법률 제67조(보고ㆍ검사 등)

① 산림청장, 시ㆍ도지사, 시장ㆍ군수ㆍ구청장 및 지방산림청장은 산림자원의 조성과 관리를 위하여 필요한 경우 다음 각 호의 어느 하나에 해당되는 자에게 업무에 관하여 보고를 명하거나 관련 자료를 제출하게 할 수 있으며, 소속 공무원으로 하여금 사업장ㆍ사무소 등에 출입하여 장부ㆍ서류나 그 밖의 물건을 조사ㆍ검사하거나 관계인에게 질문하게 할 수 있다. <개정 2012.6.1, 2014.3.11, 2016.5.29, 2019.1.8, 2022.12.27>

② 산림청장, 시ㆍ도지사, 시장ㆍ군수ㆍ구청장 및 지방산림청장은 제1항에 따라 출입ㆍ조사ㆍ검사 또는 질문을 하려는 경우에는 출입ㆍ조사ㆍ검사 또는 질문을 하기 7일 전까지 출입ㆍ조사ㆍ검사 또는 질문의 일시ㆍ이유 및 내용 등을 포함한 계획을 조사대상자에게 통지하여야 한다. 다만, 긴급하거나 사전에 통지하면 증거인멸 등으로 출입ㆍ조사ㆍ검사 또는 질문의 목적을 달성할 수 없다고 인정되는 경우에는 그러하지 아니하다. <신설 2019.1.8>

③ 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 제1항에 따라 종묘생산업자가 생산한 산림용 종자와 산림용 묘목을 조사ㆍ검사한 결과 그 품질이 불량하다고 인정하면 산림용 종자와 산림용 묘목의 출하를 금지하거나 소독ㆍ폐기 등 필요한 조치를 명할 수 있다. <개정 2012.6.1, 2014.3.11, 2017.10.31, 2019.1.8>

④ 제1항에 따라 조사하거나 검사 또는 질문을 하는 공무원은 그 신분을 표시하는 증표를 지니고 이를 관계인에게 내보여야 한다. <개정 2019.1.8>

⑤ 산림청장 또는 시ㆍ도지사는 제23조의2제4항에 따라 등록한 국유림영림단 또는 제24조제2항에 따라 등록한 산림사업법인의 등록요건을 확인ㆍ조사하기 위하여 필요한 경우에는 국유림영림단 구성인원 또는 산림사업법인 기술자의 국민건강보험, 국민연금, 고용보험 및 산업재해보상보험 등의 가입 자료의 제공을 관계 기관의 장에게 요청할 수 있다. 이 경우 관계 기관의 장은 정당한 사유가 없으면 그 요청에 따라야 한다. <신설 2017.10.31, 2019.1.8>
