산림자원의 조성 및 관리에 관한 법률 시행령 제41조(입목벌채등의 제한지역)

① 법 제36조제2항 본문에서 "대통령령으로 정하는 지역"이란 산사태ㆍ토사유출 등 산림재난 방지를 위해 시장ㆍ군수ㆍ구청장 또는 지방산림청장이 고시한 지역을 말한다. <개정 2023.5.30, 2026.1.30>

② 제1항에 따라 시장ㆍ군수ㆍ구청장 또는 지방산림청장이 입목벌채 제한지역을 고시하려는 경우에는 축척 2만 5천분의 1 이상의 지적이 표시된 지형도(「토지이용규제 기본법」 제12조에 따른 국토이용정보체계에 지적이 표시된 지형도의 데이터베이스가 구축되어 있지 않거나 지형과 지적의 불일치로 지형도의 활용이 곤란한 경우에는 지적도를 말한다)와 지번ㆍ면적을 명시하여 고시하고, 이를 산림소유자에게 통지해야 한다. 고시한 지역을 변경하거나 고시를 해제하려는 경우에도 또한 같다. <개정 2023.5.30>
