산림보호법 제15조(입산통제구역의 지정 등)

① 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장 또는 지방산림청장은 산불 예방, 자연경관 유지, 자연환경 보전, 그 밖에 산림보호를 위하여 필요하면 일정한 기간을 정하여 산림의 일부 지역(「자연공원법」에 따른 공원구역은 제외한다)을 입산통제구역으로 지정하여 사람의 출입 또는 차량의 통행을 제한할 수 있다. <개정 2014.6.3, 2018.3.20>

② 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장 또는 지방산림청장은 입산통제구역을 지정하면 그 사실, 대상 지역 및 사람의 출입 또는 차량 통행이 제한되는 기간 등을 고시하고 입산통제구역에 농림축산식품부령으로 정하는 표시를 하여야 한다. <개정 2013.3.23, 2014.6.3, 2018.3.20>

③ 입산통제구역에 들어가려는 자(차량 통행을 하려는 자를 포함한다)는 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장 또는 지방산림청장의 허가를 받아야 한다. 다만, 산림사업의 시행, 산불 진화, 그 밖에 농림축산식품부령으로 정하는 사유에 해당하는 경우에는 허가 없이 들어갈 수 있다. <개정 2013.3.23, 2014.6.3, 2018.3.20>

④ 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장 또는 지방산림청장은 제3항 본문에 따른 허가의 신청을 받은 날부터 3일 이내에 허가 여부를 신청인에게 통지하여야 한다. <신설 2018.3.20>

⑤ 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장 또는 지방산림청장이 제4항에서 정한 기간 내에 허가 여부나 민원 처리 관련 법령에 따른 처리기간의 연장을 신청인에게 통지하지 아니하면 그 기간(민원 처리 관련 법령에 따라 처리기간이 연장 또는 재연장된 경우에는 해당 처리기간을 말한다)이 끝난 날의 다음 날에 허가를 한 것으로 본다. <신설 2018.3.20>

⑥ 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장 또는 지방산림청장은 입산통제구역의 지정 목적이 달성되었거나 지정 목적이 상실된 경우에는 지체 없이 그 지정을 해제하고 그 사실을 고시하여야 한다. <개정 2014.6.3, 2018.3.20>
