사회복지사업법 시행령 제25조의2(민감정보 및 고유식별정보의 처리)
Enforcement Decree of the Social Welfare Services Act, Article 25-2 (Processing of Sensitive Information and Personal Identification Information)
① 국가, 지방자치단체의 장(법 제9조, 제12조 및 제13조와 이 영 제25조에 따라 그 업무를 위탁받은 자를 포함한다) 또는 전담기구는 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법 시행령」 제19조제1호 또는 제4호에 따른 주민등록번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <개정 2012.8.3>
(1) Where unavoidable to perform the following affairs, the State, the head of a local government (including a person entrusted with the duties thereof under Articles 9, 12, and 13 of the Act and Article 25 of this Decree), or the dedicated organization may process data including a resident registration number or foreigner registration number under Article 19, subparagraph 1 or 4 of the Enforcement Decree of the Personal Information Protection Act:
1. 법 제6조의2에 따른 정보시스템의 구축ㆍ운영에 관한 사무
1. Affairs concerning the establishment and operation of the information system under Article 6-2 of the Act;
2. 법 제9조에 따른 사회복지 자원봉사활동의 지원ㆍ육성에 관한 사무
2. Affairs concerning support for and fostering of social welfare volunteer activities under Article 9 of the Act;
3. 법 제10조에 따른 지도와 훈련에 관한 사무
3. Affairs concerning guidance and training under Article 10 of the Act;
4. 법 제11조에 따른 사회복지사 자격증 발급 등에 관한 사무
4. Affairs concerning issuance of social worker certificates, etc. under Article 11 of the Act;

6. 법 제12조에 따른 사회복지사 국가시험의 관리에 관한 사무

② 보건복지부장관(제25조에 따라 보건복지부장관의 업무를 위탁받은 자를 포함한다), 지방자치단체의 장(해당 권한이 위임ㆍ위탁된 경우에는 그 권한을 위임ㆍ위탁받은 자를 포함한다) 또는 법 제5조의2에 따라 보호대상자에 대한 서비스 제공을 실시하는 자는 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법」 제23조에 따른 건강에 관한 정보, 같은 법 시행령 제18조제2호에 따른 범죄경력자료에 해당하는 정보, 같은 영 제19조제1호, 제2호 또는 제4호에 따른 주민등록번호, 여권번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <개정 2012.8.3, 2018.4.24, 2019.6.11>
(2) Where unavoidable to perform the following affairs, the Minister of Health and Welfare (including a person entrusted with duties of the Minister under Article 25), the head of a local government (including a person to whom the relevant authority has been delegated or entrusted), or a person providing services to persons subject to protection under Article 5-2 of the Act may process data including information on health under Article 23 of the Personal Information Protection Act, information constituting criminal history data under Article 18, subparagraph 2 of the Enforcement Decree of that Act, and resident registration numbers, passport numbers, or foreigner registration numbers under Article 19, subparagraph 1, 2, or 4 of that Decree:
1. 법 제5조의2제2항에 따른 사회복지서비스 이용권에 관한 사무
1. Affairs concerning social welfare service vouchers under Article 5-2 (2) of the Act;
2. 법 제11조의2에 따른 사회복지사의 결격사유 확인에 관한 사무
2. Affairs concerning confirmation of grounds for disqualification of social workers under Article 11-2 of the Act;
3. 법 제11조의3에 따른 사회복지사의 자격취소 및 자격정지에 관한 사무
3. Affairs concerning revocation and suspension of social worker certificates under Article 11-3 of the Act;
4. 법 제44조에 따른 비용의 징수에 관한 사무
4. Affairs concerning collection of expenses under Article 44 of the Act.
