사회보장급여의 이용ㆍ제공 및 수급권자 발굴에 관한 법률 제8조(금융정보등의 제공 등)

① 중앙행정기관의 장 또는 지방자치단체의 장은 지원대상자와 그 부양의무자에 대하여 제7조제1항에 따라 금융정보 등에 대한 조사가 필요한 경우 다음 각 호의 자료 또는 정보의 제공에 대하여 동의한다는 서면을 받아야 한다.

② 보건복지부장관은 「금융실명거래 및 비밀보장에 관한 법률」 제4조제1항 및 「신용정보의 이용 및 보호에 관한 법률」 제32조제1항에도 불구하고 지원대상자와 그 부양의무자가 제1항에 따라 제출한 동의 서면을 전자적 형태로 바꾼 문서에 의하여 금융기관등(「금융실명거래 및 비밀보장에 관한 법률」 제2조제1호의 금융회사등, 「신용정보의 이용 및 보호에 관한 법률」 제2조제6호의 신용정보집중기관을 말한다. 이하 "금융기관등"이라 한다)의 장에게 금융정보ㆍ신용정보 또는 보험정보(이하 "금융정보등"이라 한다)의 제공을 요청할 수 있다.

③ 보건복지부장관은 제19조에 따른 사회보장급여의 적정성 확인조사를 위하여 필요하다고 인정하는 경우 「금융실명거래 및 비밀보장에 관한 법률」 제4조제1항 및 「신용정보의 이용 및 보호에 관한 법률」 제32조제1항에도 불구하고 대통령령으로 정하는 기준에 따라 인적사항을 적은 문서 또는 정보통신망으로 금융기관등의 장에게 수급자와 부양의무자의 금융정보등을 제공하도록 요청할 수 있다.

④ 금융정보등의 제공을 요청받은 금융기관등의 장은 「금융실명거래 및 비밀보장에 관한 법률」 제4조 및 「신용정보의 이용 및 보호에 관한 법률」 제32조에도 불구하고 명의인의 금융정보등을 제공하여야 한다.

⑤ 금융정보등을 제공한 금융기관등의 장은 금융정보등의 제공 사실을 명의인에게 통보하여야 한다. 다만, 명의인이 동의한 경우에는 「금융실명거래 및 비밀보장에 관한 법률」 제4조의2제1항 및 「신용정보의 이용 및 보호에 관한 법률」 제35조에도 불구하고 통보하지 아니할 수 있다

⑥ 금융정보등의 제공요청 및 제공은 「정보통신망 이용촉진 및 정보보호 등에 관한 법률」 제2조제1항제1호의 정보통신망을 이용하여야 한다. 다만, 정보통신망의 손상 등 불가피한 사유가 있는 경우에는 그러하지 아니하다.
