사회기반시설에 대한 민간투자법 제39조의2(임직원의 배상책임)

① 관리기관의 임원이 법령 또는 정관을 위반하거나 그 임무를 게을리함으로써 기금에 손해를 발생시킨 경우에 그 임원은 연대하여 손해를 배상할 책임을 진다.

② 기금의 신용보증업무를 담당하는 관리기관의 임직원이 그 업무처리를 하면서 고의 또는 중대한 과실로 기금에 손해를 발생시킨 경우에는 그 손해를 배상할 책임을 진다. 이 경우 고의로 손해를 발생시킨 경우를 제외하고는 그 책임을 경감할 수 있다.
