사회기반시설에 대한 민간투자법 제22조(준공확인 등)

① 사업시행자가 제15조제2항에 따라 고시된 실시계획에 따라 사업을 완료하거나 제21조제7항에 따라 고시된 부대사업을 완료하였을 때에는 지체 없이 대통령령으로 정하는 바에 따라 공사준공보고서를 주무관청에 제출하고 준공확인을 받아야 한다.

② 제1항에 따른 준공확인의 신청을 받은 주무관청은 준공검사를 한 후, 준공검사확인증을 그 신청인에게 발급하여야 한다.

③ 제2항에 따른 준공검사확인증을 발급하였을 때에는 제17조제1항 및 제21조제8항에 따른 인가ㆍ허가 등에 따른 해당 사업의 준공검사 또는 준공인가 등을 받은 것으로 본다.

④ 주무관청은 제2항에 따라 준공확인을 하거나 제3항에 따라 준공검사 또는 준공인가 등을 받은 것으로 보는 경우에는 미리 관계 행정기관의 장과 협의하여야 한다.

⑤ 제2항에 따른 준공검사확인증을 발급받기 전에 민간투자사업으로 조성 또는 설치된 토지 및 사회기반시설은 사용하여서는 아니 된다. 다만, 주무관청으로부터 준공 전 사용을 인가받은 경우에는 그러하지 아니하다.
