사행행위 등 규제 및 처벌 특례법 제23조(행정처분 효과의 승계)

제9조제1항(제13조제4항에 따라 준용되는 경우를 포함한다)에 따라 영업이 승계되면 종전의 영업자등에 대한 행정처분의 효과는 제21조제2항에 따른 처분기간이 끝난 날부터 1년간 새로운 영업자등에게 승계되며, 행정처분의 절차가 진행 중일 때에는 새로운 영업자등을 상대로 그 절차를 계속 진행할 수 있다. 다만, 새로운 영업자등(상속으로 승계받은 사람은 제외한다)이 영업을 승계할 때에 그 처분이나 위반사실을 알지 못하였음을 증명하면 그러하지 아니하다.
