빈집 및 소규모주택 정비에 관한 특례법 시행령 제36조(준공인가 및 공사완료 고시 등)
Enforcement Decree of the Special Act on Improvement of Vacant Houses and Small-Scale Housing, Article 36 (Completion Authorization and Public Notice of Completion of Construction, etc.)
① 법 제39조에 따른 준공인가의 방법ㆍ절차 및 준공인가ㆍ공사완료의 고시 방법 등에 관하여는 제13조를 준용한다. 이 경우 "빈집정비사업"은 "소규모주택정비사업"으로, "법 제14조제1항"은 "법 제39조제1항"으로, "법 제14조제2항"은 "법 제39조제2항으로", "법 제14조제3항 및 제4항"은 "법 제39조제3항 및 제4항"으로 본다.
(1) Article 13 shall apply mutatis mutandis to the method and procedures for completion authorization under Article 39 of the Act and the method of public notice of completion authorization and completion of construction, etc. In such cases, "vacant house improvement project" shall be deemed "small-scale housing improvement project", "Article 14 (1) of the Act" shall be deemed "Article 39 (1) of the Act", "Article 14 (2) of the Act" shall be deemed "Article 39 (2) of the Act", and "Article 14 (3) and (4) of the Act" shall be deemed "Article 39 (3) and (4) of the Act".
② 법 제39조제5항 본문에서 "완공된 건축물이 사용에 지장이 없는 등 대통령령으로 정하는 기준에 적합한 경우"란 다음 각 호의 기준을 모두 충족한 경우를 말한다.
(2) "Where the completed building meets the standards prescribed by Presidential Decree, such as having no obstacle to use" in the main text of Article 39 (5) of the Act means a case where all of the following standards are met:
1. 완공된 건축물에 전기ㆍ수도ㆍ난방 및 상하수도 시설 등이 갖추어져 있어 건축물의 사용에 지장이 없을 것
1. The completed building must be equipped with electricity, water, heating, and water supply and sewerage facilities, etc. so that there is no obstacle to the use of the building;
2. 완공된 건축물이 법 제29조에 따라 인가받은 사업시행계획에 적합할 것

3. 공사에 따른 차량통행ㆍ소음ㆍ분진 등의 위해로부터 입주자의 안전이 확보될 것
