비상대비에 관한 법률 시행령 제37조(훈련 참가로 인한 피해에 대한 보상)

① 법 제21조에 따른 보상을 하는 경우 훈련에 참가하여 임무수행 중 「국가유공자 등 예우 및 지원에 관한 법률」 제6조의4에 따른 상이등급 1급부터 7급까지에 해당하는 부상을 입은 사람은 같은 법 제4조제1항제6호의 공상군경으로 보고, 사망(부상으로 인하여 사망한 사람을 포함한다. 이하 같다)한 사람의 유족은 같은 법 제4조제1항제5호에 규정된 순직군경의 유족으로 보아 같은 법에 따른 보상을 한다.

② 훈련을 담당하는 사람의 소속 기관(이하 "훈련실시기관"이라 한다)의 장은 훈련에 참가하여 임무수행 중 부상을 입은 사람과 사망한 사람이 발생한 경우에는 그 사실을 지체 없이 자원관리주관기관의 장에게 보고해야 한다. <개정 2022.7.4>

③ 제1항에 따른 보상을 받기 위하여 「국가유공자 등 예우 및 지원에 관한 법률」 제6조에 따른 등록신청이 있는 경우에는 같은 법 시행령 제9조제2항을 준용한다. 이 경우 "소속기관장"은 "자원관리주관기관의 장"으로 본다. <개정 2022.7.4>
