부패방지 및 국민권익위원회의 설치와 운영에 관한 법률 제74조(감사실시의 결정)

① 제72조제1항 본문에 따라 감사청구된 사항에 대하여는 감사원규칙으로 정하는 국민감사청구심사위원회에서 감사실시 여부를 결정하여야 한다.

② 제72조제1항 단서에 따라 당해 기관의 장이 감사청구를 접수한 때에는 그 접수한 날부터 30일 이내에 국회규칙ㆍ대법원규칙ㆍ헌법재판소규칙ㆍ중앙선거관리위원회규칙 또는 감사원규칙으로 정하는 바에 따라 감사실시 여부를 결정하여야 한다.

③ 감사원 또는 당해 기관의 장은 감사청구가 이유 없다고 인정하는 때에는 이를 기각하고, 기각을 결정한 날부터 10일 이내에 그 사실을 감사청구인에게 통보하여야 한다.
