Enforcement Decree of the Act on Restoration of Honor and Compensation for Persons Related to the Bu-Ma Democratic Protests, Article 21 (Applications for Payment of Compensation, etc.)
① 법 제24조에 따라 보상금ㆍ생활지원금ㆍ의료지원금(이하 "보상금등"이라 한다)의 지급을 신청하려는 사람은 별지 제2호서식의 보상금등의 지급 신청서(전자문서로 된 신청서를 포함한다)에 다음 각 호의 서류(전자문서를 포함한다)를 첨부하여 신청인의 주소지를 관할하는 특별시ㆍ광역시ㆍ특별자치시ㆍ도ㆍ특별자치도(이하 "시ㆍ도"라 한다)를 거쳐 위원회에 제출하여야 한다. <개정 2024.7.30>
(1) A person who intends to apply for payment of compensation, livelihood support payments, and medical support payments (hereinafter referred to as "compensation, etc.") under Article 24 of the Act shall submit an application for payment of compensation, etc. in Annex Form No. 2 (including an application in the form of an electronic document), with the following documents (including electronic documents) attached, to the Committee through the Special Metropolitan City, Metropolitan City, Special Self-Governing City, Do, or Special Self-Governing Province (hereinafter referred to as "Si/Do") having jurisdiction over the applicant's address:
1. 관련자의 가족관계기록사항에 관한 증명서 또는 제적등본(가족관계기록사항에 관한 증명서로 관련자와 신청인의 관계를 확인할 수 없는 경우로서 신청인이 유족인 경우만 제출한다) 1부
1. One copy of a certificate of family relations record or a removed family register of the related person (submitted only where the family relationship between the related person and the applicant cannot be verified with a certificate of family relations record and the applicant is a bereaved family member);
2. 별지 제3호서식의 기지급치료비 지급명세서(의료지원금을 신청하는 경우만 제출하며, 기지급치료비를 증명할 수 있는 요양기관 발행 계산서ㆍ영수증을 첨부한다) 1부
2. One copy of a statement of previously paid treatment expenses in Annex Form No. 3 (submitted only when applying for medical support payments, with bills and receipts issued by medical care institutions that can prove previously paid treatment expenses attached);
3. 별지 제4호서식의 유족대표자 선정서(유족대표자를 선정한 경우만 제출하며, 위임자의 인감증명서 또는 본인서명사실확인서를 첨부한다) 1부
3. One copy of a designation of a bereaved family representative in Annex Form No. 4 (submitted only where a bereaved family representative has been selected, with the seal impression certificate or certificate of personal signature verification of the delegator attached);
4. 별지 제5호서식의 보상금등 신청 위임장(이민ㆍ입원이나 그 밖의 부득이한 사유로 대리로 신청하는 경우만 제출한다) 1부
4. One copy of a power of attorney for applying for compensation, etc. in Annex Form No. 5 (submitted only where the application is made by proxy due to emigration, hospitalization, or other unavoidable reasons);
5. 별지 제6호서식의 직업 및 월급액 증명서(근로소득자의 경우만 제출한다) 1부
5. One copy of a certificate of occupation and monthly salary in Annex Form No. 6 (submitted only for wage earners);
6. 별지 제7호서식의 직업 및 월실수령액 증명서(사업소득자의 경우만 제출한다) 1부
6. One copy of a certificate of occupation and monthly net receipts in Annex Form No. 7 (submitted only for business income earners);
7. 관련자의 구금사실 및 구금기간을 확인할 수 있는 증명서류(법 제22조제1항제1호에 해당하여 생활지원금을 신청하는 경우만 제출한다) 1부
7. One copy of documents that can verify the fact and period of detention of the related person (submitted only when applying for livelihood support payments falling under Article 22 (1) 1 of the Act);
8. 관련자의 해직사실, 재직기간 및 해직일(기간)을 확인할 수 있는 증명서류(법 제22조제1항제3호에 해당하여 생활지원금을 신청하는 경우만 제출한다) 1부
8. One copy of documents that can verify the fact of dismissal, the period of service, and the date (period) of dismissal of the related person (submitted only when applying for livelihood support payments falling under Article 22 (1) 3 of the Act);
9. 그 밖에 신청 사유를 소명할 수 있는 증거자료 1부
9. One copy of other evidentiary materials that can substantiate the grounds for the application.
② 제1항에 따라 유족이 보상금등의 지급을 신청하는 경우로서 같은 순위 재산상속인이 2명 이상인 경우에는 별지 제4호서식의 유족대표자 선정서에 따라 유족대표자를 선정하여야 한다. 다만, 같은 순위 재산상속인 간의 합의가 불가능한 경우에는 그러하지 아니하다.
(2) Where bereaved family members apply for payment of compensation, etc. under paragraph (1) and there are two or more property heirs of the same rank, a bereaved family representative shall be selected by the designation of a bereaved family representative in Annex Form No. 4. However, this does not apply where agreement among property heirs of the same rank is impossible.
③ 제1항에 따라 보상금등의 지급을 신청하려는 사람이 이민ㆍ입원이나 그 밖의 부득이한 사유로 보상금등을 직접 신청할 수 없는 경우에는 다음 각 호의 구분에 따라 해당하는 사람이 확인하는 별지 제5호서식의 보상금등 신청 위임장에 따라 대리인을 선임할 수 있다.
(3) Where a person who intends to apply for payment of compensation, etc. under paragraph (1) is unable to apply in person due to emigration, hospitalization, or other unavoidable reasons, an agent may be appointed by a power of attorney for applying for compensation, etc. in Annex Form No. 5 verified by the following persons, as classified below:
1. 이민 등 국외체류의 경우: 해외공관의 장
1. In the case of stay abroad such as emigration: the head of an overseas diplomatic mission;
2. 입원의 경우: 그 의료기관의 장
2. In the case of hospitalization: the head of the medical institution;
3. 교도소 등에 수용된 경우: 그 수용기관의 장
3. In the case of confinement in a prison, etc.: the head of the institution of confinement;
4. 그 밖의 경우: 읍ㆍ면ㆍ동장
4. In other cases: the head of an Eup, Myeon, or Dong.
④ 위원회는 제1항의 보상금등의 지급 신청을 받은 경우에 제1항 각 호의 관계 서류가 첨부되어 있지 아니한 경우에는 신청인에게 보완하게 하여야 한다.
(4) Upon receiving an application for payment of compensation, etc. under paragraph (1), where the relevant documents in each subparagraph of paragraph (1) are not attached, the Committee shall have the applicant supplement them.
⑤ 제1항에 따른 보상금등의 지급 신청서를 제출받은 위원회는 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 신청인의 주민등록표 등본을 확인하여야 한다. 다만, 신청인이 확인에 동의하지 아니하는 경우에는 이를 첨부하게 하여야 한다.
(5) Upon receiving the application for payment of compensation, etc. under paragraph (1), the Committee shall verify the applicant's certified copy of the resident registration through the shared use of administrative information under Article 36 (1) of the Electronic Government Act. However, where the applicant does not consent to the verification, the applicant shall be required to attach it.
