Enforcement Decree of the Act on Restoration of Honor and Compensation for Persons Related to the Bu-Ma Democratic Protests, Article 19 (Livelihood Support Payments)
① 법 제22조제1항제1호에 해당하는 사람이나 그 유족에게 지급하는 생활지원금은 5천만원을 초과하지 아니하는 범위에서 해당 구금일수에 기준 중위소득을 곱한 금액으로 한다. 이 경우 기준 중위소득은 생활지원금 지급결정연도의 「국민기초생활 보장법」 제2조제11호에 따른 기준 중위소득(4인가구의 기준 중위소득을 말한다)의 100분의 40에 해당하는 금액을 30일로 나누어 산출한 금액을 적용한다. <개정 2015.11.30>
(1) The livelihood support payment to be paid to a person falling under Article 22 (1) 1 of the Act or his or her bereaved family shall be the amount obtained by multiplying the number of days of detention by the standard median income, within the limit of 50 million won. In this case, the standard median income applied shall be the amount calculated by dividing by 30 days an amount equal to 40/100 of the standard median income (referring to the standard median income of a four-person household) under Article 2, subparagraph 11 of the National Basic Living Security Act for the year in which the payment of livelihood support is decided.
② 법 제22조제1항제2호에 해당하는 사람이나 그 유족에게 지급하는 생활지원금은 480만원으로 한다.
(2) The livelihood support payment to be paid to a person falling under Article 22 (1) 2 of the Act or his or her bereaved family shall be 4.8 million won.
③ 법 제22조제1항제3호에 해당하는 사람이나 그 유족에게 지급하는 생활지원금은 위원회가 인정한 해직기간에 대하여 별표 4의 기준에 따른 지급액으로 하되, 해직기간과 정년은 다음 각 호의 기준에 따라 산정한다.
(3) The livelihood support payment to be paid to a person falling under Article 22 (1) 3 of the Act or his or her bereaved family shall be the amount paid according to the standards in Attached Table 4 for the dismissal period recognized by the Committee, and the dismissal period and retirement age shall be calculated according to the following standards:
1. 해직기간은 해당 직장에서 해직된 날부터 정년일, 복직일 또는 특별채용일의 전날까지로 하고, 정년에 이르지 아니한 사람의 해직종료일은 관련자나 유족으로 결정된 후 6개월까지로 한다. 다만, 같은 종류나 비슷한 직종에 1년 이상 재직한 기간은 해직기간에서 제외할 수 있으며, 같은 종류나 비슷한 직종의 구체적인 기준은 위원회에서 정한다.
1. The dismissal period runs from the date of dismissal from the relevant workplace to the day before the retirement age date, reinstatement date, or special hiring date, and for a person who has not reached retirement age, the end date of dismissal is six months after the decision that the person is a related person or bereaved family member. However, the period of at least one year of service in the same or a similar occupation may be excluded from the dismissal period, and specific criteria for the same or a similar occupation shall be determined by the Committee;
2. 정년은 55세로 하되, 해당 직장의 정년에 관한 증명자료를 제출한 경우에는 예외로 할 수 있다.

④ 제1항 및 제3항에도 불구하고 다음 각 호의 어느 하나에 해당하는 경우에는 생활지원금을 지급하지 아니한다. <개정 2014.5.28, 2025.10.1>
(4) Notwithstanding paragraphs (1) and (3), livelihood support payments shall not be paid in any of the following cases:
1. 생활지원금 신청 전년도의 연간 가구당 소득이 「통계법」 제17조에 따라 국가데이터처장이 고시하는 지정통계에 따른 전년도 가계조사의 도시근로자 가구원 수별 가구당 월평균 가계지출비의 연간 합계액을 초과한 사람

A person whose annual household income in the year preceding the application for livelihood support exceeds the annual total of average monthly household consumption expenditure of urban worker households by number of household members in the Household Survey of the previous year under the designated statistics publicly notified by the Commissioner of the National Data Office under Article 17 of the Statistics Act;
2. 이 영 시행일 현재 다음 각 목의 어느 하나의 직에 1년 이상 재직하고 있는 사람
2. A person who, as of the date of enforcement of this Decree, has held any of the following positions for at least one year:
가. 「국가공무원법」 제2조 및 「지방공무원법」 제2조에 따른 경력직공무원 중 5급 이상의 일반직공무원(고위공무원단에 속하는 일반직공무원을 포함한다)과 「공무원임용시험령」 제27조제3항에 따른 경력경쟁채용 등 예정 계급별 경력기준표의 임용예정계급 5급 이상(고위공무원단에 속하는 일반직공무원을 포함한다)에 해당하는 대우를 받는 특정직공무원
(a) Among career public officials under Article 2 of the National State Public Officials Act and Article 2 of the Local Public Officials Act, general public officials of Grade 5 or higher (including general public officials belonging to the Senior Civil Service), and special public officials treated as equivalent to the appointment-scheduled grade of Grade 5 or higher in the career criteria table by scheduled grade for experienced-competitive appointments under Article 27 (3) of the Public Officials Appointment Examination Decree (including those belonging to the Senior Civil Service);
나. 「국가공무원법」 제2조 및 「지방공무원법」 제2조에 따른 특수경력직공무원 중 정무직공무원, 5급 상당 이상의 별정직공무원(고위공무원단에 속하는 별정직공무원을 포함한다), 「국가공무원법」 제2조 및 「공무원보수규정」 제35조에 따른 계약직공무원 중 연봉등급 5호 이상의 일반계약직공무원 및 나급 이상의 전문계약직공무원, 「지방공무원법」 제2조 및 「지방공무원보수규정」 제34조에 따른 지방계약직공무원 중 연봉등급 4호 이상 및 나급 이상의 전임계약직공무원
(b) Among special career public officials under Article 2 of the National State Regulations on Remuneration of Public Officials and Article 2 of the Regulations on Remuneration of Local Public Officials, political public officials, and public officials in special-status positions equivalent to Grade 5 or higher (including public officials in special-status positions belonging to the Senior Civil Service); among contract public officials under Article 2 of the National Public Officials Act and Article 35 of the Public Officials Remuneration Regulations, general contract public officials at salary grade 5 or higher and specialized contract public officials at grade (na) or higher; and among local contract public officials under Article 2 of the Local Public Officials Act and Article 34 of the Local Public Officials Remuneration Regulations, full-time contract public officials at salary grade 4 or higher and grade (na) or higher;
다. 「공공기관의 정보공개에 관한 법률」 제2조제3호다목 및 같은 법 시행령 제2조제2호에 해당하는 공공기관의 임원
(c) Officers of public institutions falling under Article 2, subparagraph 3 (c) of the Act on Disclosure of Information by Public Institutions and Article 2, subparagraph 2 of the Enforcement Decree of that Act.
⑤ 법 제22조제1항 각 호 중 둘 이상에 해당하는 경우에는 지급대상자에게 유리한 금액을 선택하여 지급할 수 있다.
(5) Where a person falls under two or more subparagraphs of Article 22 (1) of the Act, the amount more favorable to the person eligible for payment may be selected and paid.
