보안관찰법 제11조(보안관찰처분의 면제)

①법무부장관은 보안관찰처분대상자중 다음 각호의 요건을 갖춘 자에 대하여는 보안관찰처분을 하지 아니하는 결정(이하 "免除決定"이라 한다)을 할 수 있다.

②법무부장관은 제1항의 요건을 갖춘 보안관찰처분대상자의 신청이 있을 때에는 부득이한 사유가 있는 경우를 제외하고는 3월내에 보안관찰처분면제여부를 결정하여야 한다.

③검사는 제1항제1호 및 제2호의 요건을 갖춘 보안관찰처분대상자의 정상을 참작하여 위험성이 없다고 인정되는 때에는 법무부장관에게 면제결정을 청구할 수 있다.

④면제결정을 받은 자가 그 면제결정요건에 해당하지 아니하게 된 때에는 검사의 청구에 의하여 법무부장관은 면제결정을 취소할 수 있다.

(4) Where웨어 a어 person퍼슨 who후 has해즈 received^r러시^v브드 an앤 exemption이그젬프션 decision디시전 no노우 longer롱거 meets밋츠 the^ð더 requirements^r리콰이어먼츠 for^f포 the^ð디 exemption이그젬프션 decision,디시전 the^ð더 Minister미너스터 of어^v브 Justice저스티스 may메이 revoke^r리^v보우크 the^ð디 exemption이그젬프션 decision디시전 at앳 the^ð더 request^r리퀘스트 of어^v브 a어 prosecutor.프^r라시큐터

⑤면제결정과 면제결정청구, 면제결정취소청구 및 그 결정에 대하여는 보안관찰처분청구 및 심사결정에 관한 규정을 준용한다.

(5) The^ð더 provisions프^r러^v비전즈 on안 requests^r리퀘스츠 for^f포 security시큐^r러티 surveillance서^v베일런스 dispositions디스퍼지션즈 and앤드 examination이그재머네이션 decisions디시전즈 shall섈 apply어플라이 mutatis뮤타티즈 mutandis뮤탠디즈 to투 exemption이그젬프션 decisions,디시전즈 requests^r리퀘스츠 for^f포 exemption이그젬프션 decisions,디시전즈 requests^r리퀘스츠 for^f포 revocation^r레^v버케이션 of어^v브 exemption이그젬프션 decisions,디시전즈 and앤드 decisions디시전즈 thereon.^ð데^r론

⑥보안관찰처분의 면제결정을 받은 자는 그때부터 이 법에 의한 보안관찰처분대상자 또는 피보안관찰자로서의 의무를 면한다.
