병역법 시행령 제40조의2(승선근무예비역 필요인원의 통보 및 배정)

① 유조선, 컨테이너선, 액화천연가스(LNG)선, 원양어선, 그 밖에 병무청장이 전시ㆍ사변 또는 이에 준하는 비상시에 동원할 수 있다고 정하는 병력이나 전략물자 등을 수송할 수 있는 선박을 보유하거나 관리하고 있는 다음 각 호의 사람은 다음 해의 승선근무예비역의 필요인원을 해양수산부장관에게 매년 6월 30일까지 알려야 한다. <개정 2012.12.20, 2013.3.23>

② 해양수산부장관은 제1항에 따른 해운업 또는 수산업 분야 업체(이하 이 절에서 "해운업체등"이라 한다)의 장으로부터 필요인원을 통보받은 경우에는 매년 7월 31일까지 병무청장에게 알려야 한다. <개정 2013.3.23>

③ 병무청장은 국방부장관이 정한 군 필요인원의 충원에 지장을 주지 않는 범위에서 해양수산부장관과 협의하여 다음 해 승선근무예비역으로 편입할 수 있는 인원을 결정하고 업체의 규모, 신청한 필요인원, 복무관리 실태 및 인권침해 발생 여부 등을 고려하여 업체별로 배정한다. 이 경우 업체별 배정 기준 및 방법, 복무관리가 부실하거나 인권침해 등이 발생한 해운업체등에 대한 인원 배정의 제한 기준 및 방법 등 승선근무예비역 인원의 배정에 관한 구체적인 사항은 병무청장이 정하여 고시한다. <개정 2013.3.23, 2014.11.4, 2020.9.29>

④ 병무청장은 다음 해의 승선근무예비역 배정인원을 관할 지방병무청장(해운업체등의 주된 사무소가 있는 행정구역을 관할하는 지방병무청장이나 병무지청장을 말한다. 이하 이 절에서 같다)을 거쳐 해운업체등의 장에게 알려야 한다.
