병역법 시행령 제138조(선원의 연기처분 기준일 등)

① 법 제65조제7항에서 "대통령령으로 정하는 날"이란 병역판정검사 또는 재병역판정검사 결과 사회복무요원 소집 대상인 보충역으로 처분된 이후 최초의 승선출국일을 말한다. <개정 2011.11.23, 2013.12.4, 2016.11.29>

② 법 제65조제7항에 따른 선원의 연기사유는 그 사회복무요원 소집 연기기간 중에 계속되어야 한다. 이 경우 하선 후 6개월 이내에 재승선한 경우에는 계속 승선한 것으로 보아 연기사유가 계속된 것으로 보되, 연기사유가 계속된 것으로 보는 하선기간은 1년의 기간 내에 통틀어 6개월을 초과할 수 없고, 1년의 기간 내에 통틀어 3개월을 초과하는 하선기간은 연기기간에 산입하지 아니한다. <개정 2011.11.23, 2013.12.4>

③ 제2항 후단에 위반하여 하선기간이 1년의 기간 내에 통틀어 6개월을 초과하는 경우에는 지방병무청장은 선원의 연기처분을 취소하고 사회복무요원으로 소집하여야 한다. <개정 2013.12.4>
