병역법 시행령 제117조(학군 군간부후보생 제적자의 처리)

① 각 군 참모총장은 법 제57조제2항에 따른 학군 군간부후보생을 「학생군사교육실시령」 제6조에 따라 제적한 경우에는 14일 이내에 그 사유와 명단을 병무청장에게 송부하여야 하며, 이를 송부받은 병무청장은 지체 없이 지방병무청장에게 송부하여 편입되기 전의 신분으로 복귀시켜 현역병입영 또는 사회복무요원으로 소집하게 하여야 한다. 다만, 19세 이하의 사람에 대해서는 학군 군간부후보생으로 편입되기 전의 신분으로 관리하여야 한다. <개정 2013.12.4, 2016.11.29>

② 지방병무청장은 제1항에 따른 제적자 명단을 받은 경우에는 「군인사법」 제10조에 따른 장교ㆍ부사관 임용결격사유에 해당되는 사람, 정해진 군사교육을 받지 않거나 군사교육 평가에 불합격된 사람, 정해진 군사교육 과정을 모두 이수할 때까지 졸업할 수 없는 사람으로서 제적된 사람에 대해서는 학교별 제한연령까지 입영이나 소집을 계속 연기할 수 있으며, 제적된 사람에게 질병이나 심신장애가 있는 경우에는 병역판정검사장 또는 군병원에서 신체검사를 거쳐 제135조제5항을 준용하여 병역처분을 할 수 있다. <개정 2013.12.4, 2016.11.29, 2021.10.14>
