별정우체국법 시행령 제39조(사망조위금의 지급대상 및 청구절차)

① 법 제25조의5제1항 후단에서 "대통령령으로 정하는 1명의 직원"이란 다음 각 호의 순위에 따른 직원 중 선순위자를 말한다.

② 법 제25조의5제2항에 따라 사망한 직원에게 배우자가 없는 경우에는 장례를 행하는 사람 중 다음 각 호의 순위에 따른 선순위자에게 사망조위금을 지급한다. 다만, 사망한 직원의 직계비속 중 직원이 있는 경우에는 그 직원에게 지급한다. <개정 2021.1.5>

③ 법 제25조의5에 따라 사망조위금을 받으려는 사람은 사망조위금청구서(전자문서로 된 청구서를 포함한다)에 다음 각 호의 서류(전자문서를 포함한다)를 첨부하여 소속 국장의 확인을 받아 관할우체국장을 거쳐 연금관리단에 제출하여야 한다. 다만, 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 첨부서류에 대한 정보를 확인할 수 있는 경우에는 그 확인으로 첨부서류를 갈음한다.
