변리사법 제13조(변리사회에 대한 감독)

① 지식재산처장은 변리사회를 감독한다. <개정 2025.10.1>

② 지식재산처장은 필요하다고 인정할 때에는 변리사회에 보고서 제출을 요구하거나 소속 공무원으로 하여금 변리사회의 업무상황 기록과 그 밖의 서류를 검사하게 할 수 있다. <개정 2025.10.1>

③ 지식재산처장은 제2항에 따른 검사를 하려면 검사 7일 전까지 검사의 일시, 이유 및 내용 등을 포함한 검사계획을 관계인에게 통보하여야 한다. 다만, 긴급히 검사하여야 하거나 사전에 알리면 증거인멸 등으로 검사 목적을 달성하기 어렵다고 인정할 때에는 그러하지 아니하다. <개정 2025.10.1>

④ 제2항에 따라 검사를 하는 공무원은 그 권한을 표시하는 증표를 지니고 이를 관계인에게 보여 주어야 하며, 출입 시 성명, 출입시간, 출입목적 등이 표시된 문서를 관계인에게 내주어야 한다.
