범죄피해자 보호법 시행령 제40조의2(자료 등의 파기 방법 및 열람ㆍ복사 요청)
Enforcement Decree of the Crime Victim Protection Act, Article 40-2 (Methods of Destroying Data, etc. and Requests for Inspection and Copying)
① 법 제29조의2제5항 및 제29조의3제7항에 따른 자료 등의 파기 방법은 각각 「개인정보 보호법 시행령」 제16조에 따른다.
(1) The methods of destroying data, etc. under Article 29-2 (5) and Article 29-3 (7) of the Act shall be in accordance with Article 16 of the Enforcement Decree of the Personal Information Protection Act, respectively.
② 지구심의회의 위원장은 법 제29조의3제1항에 따른 금융정보등의 제공 요청 여부를 결정하는 데 필요한 경우 다음 각 호의 자료를 보관하고 있는 공소청에 해당 자료의 열람 또는 복사를 요청할 수 있다. <개정 2026.9.29>
(2) The chairperson of the District Deliberation Council may, where necessary to decide whether to request provision of financial information, etc. under Article 29-3 (1) of the Act, request the Public Prosecution Office holding the following data to allow inspection or copying thereof:
1. 구조대상 범죄피해를 원인으로 하여 가해자에게 유죄판결이 선고되거나 약식명령이 확정된 사건의 재판서
1. A written judgment in a case in which a guilty verdict was pronounced against the offender or a summary order became final and conclusive on the basis of the criminal damage subject to relief;
2. 구조대상 범죄피해를 원인으로 하는 수사 또는 재판 절차에서 가해자가 범죄사실 또는 공소사실을 자백하는 진술이 기재된 서류
2. Documents containing statements in which the offender confessed to the criminal facts or the facts charged in investigation or trial proceedings based on the criminal damage subject to relief.
