다중인명피해사고 발생에 형사적 책임이 있는 개인, 법인 및 경영지배ㆍ경제적 연관 또는 의사결정에의 참여 등을 통해 그 법인을 실질적으로 지배하는 자에 대한 이 법에 따른 몰수대상재산에 관한 추징은 범인 외의 자가 그 정황을 알면서 취득한 몰수대상재산 및 그로부터 유래한 재산에 대하여 그 범인 외의 자를 상대로 집행할 수 있다.
