방송통신발전 기본법 제25조(기금의 조성)

① 기금은 다음 각 호의 재원으로 조성한다.

② 방송미디어통신위원회는 「방송법」에 따른 지상파방송사업자 및 종합편성 또는 보도에 관한 전문편성을 행하는 방송채널사용사업자로부터 전년도 방송광고 매출액에 그 100분의 6의 범위에서 방송미디어통신위원회가 정하여 고시하는 징수율을 곱하여 산정한 분담금을 징수할 수 있다. <개정 2013.3.23, 2013.8.13, 2015.1.20, 2025.10.1>

③ 방송미디어통신위원회는 「방송법」에 따른 종합유선방송사업자, 위성방송사업자 및 「인터넷 멀티미디어 방송사업법」에 따른 인터넷 멀티미디어 방송 제공사업자로부터 전년도 방송서비스 매출액에 그 100분의 6의 범위에서 방송미디어통신위원회가 정하여 고시하는 징수율을 곱하여 산정한 분담금을 징수할 수 있다. <개정 2013.3.23, 2013.8.13, 2015.1.20, 2017.7.26, 2025.10.1>

④ 방송미디어통신위원회는 상품 소개와 판매에 관한 전문편성을 하는 방송채널사용사업자로부터 전년도 결산상 영업이익에 그 100분의 15의 범위에서 방송미디어통신위원회가 정하여 고시하는 징수율을 곱하여 산정한 분담금을 징수할 수 있다. <개정 2013.3.23, 2013.8.13, 2015.1.20, 2017.7.26, 2025.10.1>

⑤ 방송미디어통신위원회는 대통령령으로 정하는 바에 따라 사업 규모나 부담 능력이 일정한 기준에 미치지 못한 자에 대하여는 제1항제3호의 분담금을 면제하거나 경감할 수 있으며, 방송통신의 공공성ㆍ수익성과 방송통신사업자의 재정상태 등에 따라 방송통신사업자별로 그 징수율을 차등 책정할 수 있다. <개정 2013.3.23, 2015.1.20, 2017.7.26, 2025.10.1>

⑥ 방송미디어통신위원회는 제1항제3호에 따른 분담금의 부과금액이 대통령령으로 정하는 기준을 초과하는 경우에는 대통령령으로 정하는 바에 따라 그 금액을 분할하여 내게 할 수 있다. <신설 2019.12.10, 2025.10.1>

⑦ 방송미디어통신위원회는 제2항부터 제4항까지의 규정에 따라 분담금을 납부하여야 할 자가 납부기한까지 이를 납부하지 아니한 때에는 체납된 금액의 100분의 3을 초과하지 아니하는 범위에서 대통령령으로 정하는 바에 따라 가산금을 부과할 수 있다. <개정 2013.3.23, 2017.7.26, 2019.12.10, 2025.10.1>
