방사성폐기물 관리법 시행령 제11조(관리비용 또는 부담금의 선납)

① 기후에너지환경부장관은 법 제16조제1항에 따라 원자력발전사업자에게 관리비용 또는 부담금을 미리 내게 할 때에는 내야 하는 관리비용 또는 부담금의 금액, 그 산정 근거, 납부기한 및 납부 장소와 그 밖에 필요한 사항을 기재한 서면(전자문서를 포함한다)으로 고지하여야 한다. <개정 2013.3.23, 2025.10.1>

② 제1항에 따른 관리비용 또는 부담금은 기금의 관리ㆍ운용 현황, 건설비용이 포함된 방사성폐기물 관리시설의 건설계획 등을 고려하여 원자력발전사업자와 협의를 거쳐 산정하되, 해당 방사성폐기물 관리시설의 건설에 소요될 것으로 예상되는 비용을 초과하여서는 아니 된다.

③ 기후에너지환경부장관은 기금에서 방사성폐기물 관리시설의 건설비용에 충당한 금액과 미리 납부된 관리비용 또는 부담금을 합한 금액이 해당 방사성폐기물 관리시설의 건설비용을 초과하는 경우에는 그 초과분을 원자력발전사업자에게 반환하거나 원자력발전사업자가 원하는 경우에는 앞으로 낼 관리비용 또는 부담금과 상계(相計)할 수 있다. 이 경우 미리 납부된 날의 다음 날부터 반환하거나 상계하는 날까지의 기간에 대하여는 별표 3에서 정한 이자율에 따라 계산한 금액을 초과 납부된 관리비용 또는 부담금에 가산(加算)하여 반환하거나 상계하여야 한다. <개정 2013.3.23, 2025.10.1>

④ 기후에너지환경부장관은 미리 납부된 관리비용 또는 부담금 중 제3항에 따른 초과분을 제외한 관리비용 또는 부담금에 대하여는 원자력발전사업자가 앞으로 낼 관리비용 또는 부담금과 상계한다. 이 경우 미리 납부된 날의 다음 날부터 상계하는 날까지의 기간에 대하여 별표 3에서 정한 이자율에 따라 계산한 금액을 미리 납부된 관리비용 또는 부담금에 가산하여 상계하여야 한다. <개정 2013.3.23, 2025.10.1>
