발명진흥법 제50조(산업재산권의 공유 및 상호사용 촉진)

①지식재산처장은 사용자등이 다른 사용자등과 산업재산권의 공유 또는 공동사용협약을 체결하여 각자 보유하고 있는 산업재산권에 대한 공동소유 또는 통상실시권의 상호허여(이하 "산업재산권의 공유 및 상호사용"이라 한다)를 촉진하기 위하여 필요한 지원시책을 수립ㆍ시행하여야 한다. <개정 2025.10.1>

②제1항에 따른 지원시책에는 다음 각 호의 사항이 포함되어야 한다.

③지식재산처장은 제1항에 따라 산업재산권의 공유 및 상호사용협약을 체결한 사용자등이 산업재산권의 공유 및 상호사용 대상 기술 분야에 대한 공동기술을 개발할 때 그에 따른 비용을 제55조에 따른 기금, 「산업기술혁신 촉진법」 제11조제2항에 따른 산업기술개발사업을 위한 자금, 「중소기업진흥에 관한 법률」 제63조에 따른 중소벤처기업창업 및 진흥기금 등에서 먼저 지원하도록 산업통상부장관 또는 제52조에 따른 한국발명진흥회 회장에게 요청할 수 있다. <개정 2008.2.29, 2009.5.21, 2010.1.27, 2013.3.23, 2018.12.31, 2025.10.1>
