발명진흥법 제38조(각종 규격의 개정 요청)

산업재산권으로 등록된 발명이 기존 규격과 달라 국가, 지방자치단체 또는 「공공기관의 운영에 관한 법률」 제4조에 따른 공공기관 등의 물품 구매 대상에서 제외되는 경우 지식재산처장은 해당 규격을 관리하는 관계 행정기관의 장에게 그 발명에 따른 제품이 구매 대상에 포함될 수 있도록 관련 규격의 개정이나 보완을 요청할 수 있다. <개정 2009.3.18, 2025.10.1>
