발명진흥법 제31조의5(평가정보체계 구축ㆍ운영)

① 지식재산처장은 발명 등의 평가에 대한 효율적이고 체계적인 조사 및 관리를 위하여 평가기관이 수행하는 발명 등의 평가 결과 및 그와 관련된 자료를 통합하여 관리할 수 있는 체계(이하 "평가정보체계"라 한다)를 구축ㆍ운영할 수 있다. <개정 2025.10.1>

② 평가기관은 평가정보체계 구축을 위하여 필요한 제28조제4항에 따른 평가 결과서 및 관련 자료를 대통령령으로 정하는 바에 따라 지식재산처장 또는 제31조의6제1항에 따른 평가관리센터의 장에게 제출하여야 한다. 다만, 개인정보 보호 등 대통령령으로 정하는 정당한 사유가 있는 경우에는 해당 사유가 있는 부분을 제외하고 제출할 수 있다. <개정 2025.10.1>

③ 평가기관은 제28조제3항에 따라 발명 등의 평가를 의뢰받을 때 의뢰한 자에게 같은 조 제4항에 따른 평가 결과서가 타당성조사, 표본조사 등 대통령령으로 정하는 사유로 활용될 수 있다는 사실을 알려야 한다.

④ 지식재산처장은 평가정보체계의 구축ㆍ운영을 위하여 필요한 경우 관계 기관에 자료의 제출을 요청할 수 있다. 이 경우 자료 제출을 요청받은 기관은 특별한 사유가 없으면 그 요청을 따라야 한다. <개정 2025.10.1>

⑤ 그 밖에 평가정보체계의 구축ㆍ운영에 필요한 사항은 대통령령으로 정한다.
