민간임대주택에 관한 특별법 제61조(보고ㆍ검사 등)

① 국토교통부장관 또는 지방자치단체의 장은 필요하다고 인정할 때에는 임대사업자, 주택임대관리업자, 그 밖에 이 법에 따른 인가ㆍ승인 또는 등록을 한 자에게 필요한 보고를 하게 하거나 관계 공무원으로 하여금 사업장에 출입하여 필요한 검사를 하게 할 수 있다.

② 제1항에 따른 검사를 할 때에는 검사 7일 전까지 검사 일시, 검사 이유 및 검사 내용 등 검사계획을 검사를 받을 자에게 알려야 한다. 다만, 긴급한 경우나 사전에 통지하면 증거인멸 등으로 검사 목적을 달성할 수 없다고 인정하는 경우에는 그러하지 아니하다.

③ 제1항에 따라 검사를 하는 공무원은 그 권한을 나타내는 증표를 지니고 이를 관계인에게 내보여야 한다.

④ 지방자치단체의 장은 제5조에 따른 임대주택 등록실적, 제46조에 따른 임대조건 등 대통령령으로 정한 사항에 대하여 분기마다 그 분기가 끝나는 달의 다음 달 말일까지 국토교통부장관에게 보고하여야 한다.
