물환경보전법 시행령 제47조(배출시설에 대한 기준초과배출량의 산정)

① 제45조제1항에 따른 기준초과배출량(폐수무방류배출시설에서 배출되는 경우는 제외한다)은 다음 각 호의 구분에 따른 배출기간 중에 배출허용기준을 초과하여 조업함으로써 배출한 수질오염물질의 양으로 하되, 일일기준초과배출량에 배출기간의 일수를 곱하여 산정한다. 다만, 측정기기부착사업장등의 기준초과배출량은 24시간 평균치가 배출허용기준을 초과한 그 24시간의 배출허용기준 초과농도(배출허용기준을 초과한 24시간 평균치에서 배출허용기준농도를 뺀 값을 말한다)에 해당 24시간의 평균배출유량을 곱하여 산정한다. <개정 2023.4.4>

② 제1항에 따른 일일기준초과배출량은 법 제39조ㆍ제40조ㆍ제42조 또는 법 제44조에 따른 개선명령ㆍ조업정지명령ㆍ허가취소ㆍ사용중지명령 또는 폐쇄명령의 원인이 되는 배출오염물질 채취일(제40조제1항제1호에 따라 개선계획서를 제출한 경우에는 법 제68조제1항에 따라 관계 공무원이 수질오염물질을 채취한 날을, 제40조제1항제2호에 따라 개선계획서를 제출한 경우에는 관계 공무원이 법 제68조제3항에 따라 시료를 채취한 날을 말한다) 당시의 수질오염물질의 배출허용기준 초과농도에, 그 배출농도 측정시의 폐수의 유량(이하 "측정유량"이라 한다)에 따라 계산한 일일유량을 곱하여 산정한 양을 킬로그램 단위로 표시한 양으로 한다.

③ 제1항에 따른 배출기간은 일수로 표시하며, 그 기간을 계산하는 방법은 「민법」을 따르되, 첫날을 산입한다.

④ 제2항에 따른 일일기준초과배출량 및 일일유량은 별표 15에 따라 산정하고, 측정유량은 「환경분야 시험ㆍ검사 등에 관한 법률」 제6조에 따른 환경오염공정시험기준에 따라 산정한다. 다만, 산정이 불가능하거나 실제유량과 현저한 차이가 있다고 인정되는 측정유량의 경우에는 다음 각 호의 방법에 따라 산정한다.
