문화유산의 보존 및 활용에 관한 법률 제61조의2(건조물 등에 포장되어 있는 일반동산문화유산의 발견신고 등)

① 건조물 등에 포장(包藏)되어 있는 일반동산문화유산의 발견자나 그 건조물 등의 소유자ㆍ점유자 또는 관리자는 그 현상을 변경하지 말고 대통령령으로 정하는 바에 따라 그 발견된 사실을 국가유산청장에게 신고하여야 한다. <개정 2024.2.13>

② 제1항에 따라 발견신고된 일반동산문화유산의 처리방법, 소유권 판정 및 국가귀속 등에 필요한 사항은 「매장유산 보호 및 조사에 관한 법률」 제18조부터 제20조까지를 준용한다.

③ 제2항에도 불구하고 제1항에 따라 발견신고된 일반동산문화유산의 소유권을 판정하는 경우 해당 일반동산문화유산이 발견된 건조물 등을 소유 또는 점유한 자가 제1항에 따른 발견신고 후 90일 이내에 그 일반동산문화유산의 소유자임을 주장하면서 그 건조물 등을 계속하여 소유 또는 점유(승계하여 소유 또는 점유하는 경우를 포함한다)하고 있음을 역사고증 등 대통령령으로 정하는 방법으로 증명하는 때에는 그 소유권 판정 결과 정당한 소유자가 있는 것으로 판정된 경우를 제외하고는 그 건조물 등의 소유자 또는 점유자를 해당 일반동산문화유산의 소유자로 추정한다.
