마약류 불법거래 방지에 관한 특례법 제73조(공소 제기 전의 보전기간)

① 몰수 또는 추징을 목적으로 하는 보전공조요청이 공소가 제기되지 아니한 사건에 대한 것인 경우에는 몰수보전명령 또는 추징보전명령이 내려진 날부터 45일 이내에 요청국으로부터 그 사건에 대하여 공소가 제기되었다는 취지의 통지가 없을 때에는 그 몰수보전명령 또는 추징보전명령은 효력을 잃는다.

② 법관은 요청국으로부터 부득이한 사유로 제1항에 따른 기간에 공소를 제기할 수 없다는 취지의 통지가 있는 때에는 검사의 청구에 의하여 30일을 초과하지 아니하는 범위에서 보전기간을 갱신할 수 있다. 부득이한 사유로 갱신된 기간에 공소를 제기할 수 없다는 취지의 통지가 있는 경우에도 또한 같다.
