마약류 불법거래 방지에 관한 특례법 제49조(담보권의 실행을 위한 경매 절차와의 조정)

① 몰수보전재산상에 존재하는 담보권이 몰수보전된 후에 성립되거나 부대보전명령에 따라 처분이 금지된 경우 그 담보권의 실행(압류는 제외한다)은 몰수보전명령 또는 부대보전명령에 따른 처분금지가 실효되지 아니하면 할 수 없다.

② 담보권을 실행하기 위한 경매 절차가 시작된 후 그 담보권에 대하여 부대보전명령이 내려진 경우 검사가 그 명령의 등본을 제출하였을 때에는 집행법원은 그 절차를 정지하여야 한다. 이 경우 「민사집행법」을 적용할 때에는 같은 법 제266조제1항제5호(같은 법 제269조 및 제272조에서 준용하는 경우를 포함한다)의 문서가 제출된 것으로 본다.
