마약류 불법거래 방지에 관한 특례법 제41조(그 밖의 재산권에 대한 몰수보전)

① 제37조부터 제40조까지의 규정에 따른 재산 외의 재산권(이하 이 조에서 "그 밖의 재산권"이라 한다)의 몰수보전에 관하여는 이 조에 특별히 정한 사항을 제외하고는 채권의 몰수보전의 예에 따른다.

② 그 밖의 재산권 중 채무자 또는 이에 준하는 자가 없는 경우(제3항의 경우는 제외한다) 몰수보전의 효력은 몰수보전명령 등본이 그 권리자에게 송달된 때에 발생한다.

③ 그 밖의 재산권 중 권리 이전을 할 때 등기등이 필요한 경우에 관하여는 제37조제3항부터 제6항까지, 「민사집행법」 제94조제2항 및 제95조를 준용한다. 이 경우 「민사집행법」 제94조제2항 중 "제1항" 및 같은 법 제95조 중 "제94조"는 "「마약류 불법거래 방지에 관한 특례법」 제41조제3항에 따라 준용되는 제37조제4항"으로 보고, 「민사집행법」 제95조 중 "법원"은 "검사"로 본다.
