마약류 불법거래 방지에 관한 특례법 제40조(채권의 몰수보전)

① 채권의 몰수보전은 채권자에게는 채권의 처분과 영수(領收)를 금지하고, 채무자에게는 채권자에 대한 지급을 금지하는 내용의 몰수보전명령에 따라 한다.

(1) Confiscation칸^f퍼스케이션 preservation프^r레저^v베이션 of어^v브 a어 claim클레임 shall섈 be비 made메이드 by바이 a어 confiscation칸^f퍼스케이션 preservation프^r레저^v베이션 order오더 prohibiting프^r로히버팅 the^ð더 creditor크^r레더터 from^f프^r럼 disposing디스포우징 of어^v브 or오 collecting컬렉팅 the^ð더 claim클레임 and앤드 prohibiting프^r로히버팅 the^ð더 debtor데터 from^f프^r럼 paying페이잉 the^ð더 creditor.크^r레더터

② 제1항의 몰수보전명령 등본은 채권자 및 채무자에게 송달하여야 한다.

③ 채권에 대한 몰수보전의 효력은 몰수보전명령 등본이 채무자에게 송달된 때에 발생한다.

④ 몰수보전명령에 따라 몰수보전된 금전의 지급을 목적으로 하는 채권(이하 "금전채권"이라 한다)의 채무자(이하 제46조 및 제50조에서 "제3채무자"라 한다)는 그 채권액에 상당하는 금액을 공탁할 수 있다. 이 경우 채권자의 공탁금 출급청구권에 대하여 몰수보전집행이 된 것으로 본다.

⑤ 채권의 몰수보전에 관하여는 「민사집행법」 제228조를 준용한다. 이 경우 「민사집행법」 제228조제1항 중 "압류"는 "몰수보전"으로, "채권자"는 "검사"로 보고, 같은 조 제1항 및 제2항 중 "압류명령"은 "몰수보전명령"으로 본다.
