마약류 불법거래 방지에 관한 특례법 제28조(몰수재판의 제한)
Special Act on the Prevention of Illegal Trafficking in Narcotics, etc., Article 28 (Restriction on Confiscation Judgments)
제3자가 참가허가를 받지 못한 경우에는 다음 각 호의 어느 하나에 해당하는 경우를 제외하고는 제3자가 가진 재산이나 제3자가 지상권ㆍ저당권 또는 그 밖의 권리를 그 위에 가지고 있는 재산에 대하여 몰수재판을 할 수 없다.
Where a third party has not been granted permission to participate, a confiscation judgment may not be made regarding property held by the third party or property on which the third party holds a superficies, mortgage, or other right, except in any of the following cases:
1. 제23조제1항에 따른 고지 또는 같은 조 제2항에 따른 공고가 있었던 날부터 14일이 지났을 경우. 다만, 다음 각 목의 어느 하나에 해당하면 몰수재판을 할 수 없다.
1. Where 14 days have elapsed from the date of the notice under Article 23 (1) or the public notice under paragraph (2) of the same Article. However, a confiscation judgment may not be made in any of the following cases:
가. 몰수하여야 할 재산이나 몰수하여야 할 재산상에 존재하는 지상권ㆍ저당권 또는 그 밖의 권리가 참가신청인 또는 참가인에게 귀속하지 아니함이 명백하다는 이유로 참가신청이 기각되었을 때
(a) Where the application for participation was dismissed on the ground that it is clear that the property to be confiscated, or a superficies, mortgage, or other right existing on the property to be confiscated, does not belong to the applicant or participant;
나. 몰수가 불가능하거나 불필요하다는 검사의 의견에 따라 참가신청이 기각되었을 때
(b) Where the application for participation was dismissed according to the prosecutor's opinion that confiscation is impossible or unnecessary; and
다. 참가를 허가한 재판이 취소되었을 때
(c) Where the judgment permitting participation was revoked;
2. 참가신청이 법률에 규정된 방식에 위반되어 기각되었을 경우

3. 참가신청의 취하가 있을 경우
