제40조의2제2항에 따라 이수명령을 부과받은 사람이 보호관찰소의 장 또는 교정시설의 장의 이수명령 이행에 관한 지시에 불응하여 「보호관찰 등에 관한 법률」 또는 「형의 집행 및 수용자의 처우에 관한 법률」에 따른 경고를 받은 후 재차 정당한 사유 없이 이수명령 이행에 관한 지시에 불응한 경우에는 다음 각 호에 따른다.

1. 징역형 이상의 실형과 병과된 경우에는 1년 이하의 징역 또는 1천만원 이하의 벌금에 처한다.
