디엔에이신원확인정보의 이용 및 보호에 관한 법률 시행령 제7조(디엔에이감식시료채취영장의 집행 등)

① 검찰총장 및 경찰청장은 법 제8조에 따라 디엔에이감식시료를 채취하기 위한 영장(이하 "디엔에이감식시료채취영장"이라 한다)이 발부되고 검사의 지명수배ㆍ통보 결정이 있는 경우 검사 또는 사법경찰관리가 지명수배ㆍ통보관리와 관련된 전산자료를 통하여 그 사실을 조회할 수 있도록 하여야 한다.

② 법 제5조 또는 제6조에 따른 디엔에이감식시료 채취대상자에 대하여 법 제8조제7항에 따라 디엔에이감식시료채취영장의 집행지휘를 받은 사법경찰관리 또는 수용기관 소속 공무원은 지체 없이 디엔에이감식시료 채취대상자로부터 디엔에이감식시료를 채취하여야 한다. <개정 2026.9.29>

(2) With위^ð드 respect^r리스펙트 to투 a어 person퍼슨 from^f프^r럼 whom훔 a어 DNA디에네이 sample샘플 is이즈 to투 be비 collected컬렉티드 under언더 Article아터클 5 or오 6 of어^v브 the^ð디 Act,액트 a어 judicial주디실 police펄리스 official어^f피실 or오 a어 public퍼블릭 official어^f피실 of어^v브 a어 custodial커스토우디얼 institution인스티투션 who후 has해즈 been빈 directed더^r렉티드 to투 execute엑서큣 the^ð더 warrant워^r런트 for^f포 collecting컬렉팅 DNA디에네이 samples샘플즈 pursuant퍼수언트 to투 Article아터클 8 (7) of어^v브 the^ð디 Act액트 shall섈 without위^ð다웃 delay딜레이 collect컬렉트 a어 DNA디에네이 sample샘플 from^f프^r럼 that^ð댓 person.퍼슨

③ 제2항에 따라 디엔에이감식시료를 채취한 사법경찰관 또는 수용기관 소속 공무원은 채취한 디엔에이감식시료와 다음 각 호의 서류를 즉시 검사에게 보내야 한다. 다만, 법 제8조제7항에 따라 디엔에이감식시료채취영장의 집행지휘를 받은 사법경찰관(수용기관 소속의 사법경찰관은 제외한다)이 법 제6조에 따른 디엔에이감식시료 채취대상자로부터 디엔에이감식시료를 채취한 경우는 제외한다. <개정 2026.9.29>
