도시재생 활성화 및 지원에 관한 특별법 제55조의5(계약의 방법 및 시공자 선정 등)

① 주거재생혁신지구의 혁신지구사업시행자가 시공자를 선정하는 경우 토지등소유자는 소유자 전원으로 구성된 회의(이하 "토지등소유자 전체회의"라 한다)의 의결을 거쳐 대통령령으로 정하는 바에 따라 경쟁입찰 또는 수의계약(2회 이상 경쟁입찰이 유찰된 경우로 한정한다)의 방법으로 시공자를 추천할 수 있다. 이 경우 토지등소유자 전체회의의 구성 및 운영에 관한 사항은 대통령령으로 정한다.

② 제1항에 따라 토지등소유자가 시공자를 추천한 경우 혁신지구사업시행자는 추천받은 자를 시공자로 선정하여야 한다. 이 경우 시공자와의 계약에 관하여는 「국가를 당사자로 하는 계약에 관한 법률」 제7조, 「지방자치단체를 당사자로 하는 계약에 관한 법률」 제9조, 「공공기관의 운영에 관한 법률」 제39조 또는 「지방공기업법」 제64조의2를 적용하지 아니한다.
