도시가스사업법 제10조의5(천연가스의 수출입 승인 등)

① 도시가스사업자인 천연가스수출입업자는 천연가스의 수입계약ㆍ수출계약 또는 수송계약을 체결하려면 산업통상부령으로 정하는 바에 따라 도시가스 수급상의 필요성과 가격의 적정성 등의 요건을 모두 갖추어 산업통상부장관의 승인을 받아야 한다. 승인을 받은 계약의 내용을 변경하려는 경우에도 또한 같다. <개정 2008.2.29, 2009.3.25, 2013.3.23, 2025.10.1>

② 제1항에도 불구하고 도시가스사업자인 천연가스수출입업자가 체결하려는 천연가스의 수입계약ㆍ수출계약 또는 수송계약이 물량 및 기간 등에 관하여 대통령령으로 정하는 계약에 해당하는 경우에는 산업통상부령으로 정하는 바에 따라 그 계약 체결 이후 산업통상부장관에게 신고하여야 한다. 신고한 계약의 내용을 변경하는 경우에도 또한 같다. <신설 2014.12.30, 2025.10.1>

③ 자가소비용직수입자인 천연가스수출입업자는 천연가스의 수입계약ㆍ수출계약 또는 수송계약을 체결한 때에는 산업통상부령으로 정하는 바에 따라 산업통상부장관에게 신고하여야 한다. 신고한 계약의 내용을 변경한 경우에도 또한 같다. <개정 2008.2.29, 2013.3.23, 2014.1.21, 2014.12.30, 2025.10.1>

④ 자가소비용직수입자는 제3항에 따른 천연가스의 수입계약ㆍ수출계약을 체결하려면 그 계약을 체결하기 전에 수입ㆍ수출의 물량 규모 및 시기 등을 산업통상부령으로 정하는 바에 따라 산업통상부장관에게 미리 통보하여야 한다. <개정 2008.2.29, 2013.3.23, 2014.1.21, 2014.12.30, 2025.10.1>

⑤ 천연가스반출입업자는 천연가스를 반입ㆍ반출하기 위한 계약 또는 수송계약을 체결한 때에는 산업통상부령으로 정하는 바에 따라 산업통상부장관에게 신고하여야 한다. 신고한 계약의 내용을 변경한 경우에도 또한 같다. <신설 2014.1.21, 2014.12.30, 2025.10.1>

⑥ 산업통상부장관은 제2항, 제3항 또는 제5항에 따른 신고ㆍ변경신고를 받은 날부터 5일 이내에 신고수리 여부를 신고인에게 통지하여야 한다. <신설 2022.2.3, 2025.10.1>

⑦ 산업통상부장관이 제6항에서 정한 기간 내에 신고수리 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장을 신고인에게 통지하지 아니하면 그 기간(민원 처리 관련 법령에 따라 처리기간이 연장 또는 재연장된 경우에는 해당 처리기간을 말한다)이 끝난 날의 다음 날에 신고를 수리한 것으로 본다. <신설 2022.2.3, 2025.10.1>
