Enforcement Decree of the Road Act, Article 78 (Standards and Procedures for Emergency Traffic Restrictions)
① 법 제76조제6항에 따라 차량의 도로 진입이나 도로에 진행 중인 차량의 통행을 일시적으로 금지 또는 제한(이하 "긴급 통행제한"이라 한다)할 수 있는 기준은 다음 각 호와 같다. <개정 2015.10.29, 2026.5.6>
(1) The standards for temporarily prohibiting or restricting the entry of vehicles onto a road or the traffic of vehicles traveling on a road under Article 76 (6) of the Act (hereinafter referred to as "emergency traffic restriction") are as follows:
1. 해당 구간에 노면 적설량이 10센티미터 이상인 경우
1. Where the snow depth on the road surface in the relevant section is 10 centimeters or more;
2. 해당 구간에 시간당 평균 적설량이 3센티미터 이상인 상태가 6시간 이상 지속되는 경우
2. Where an average hourly snowfall of 3 centimeters or more continues for six hours or more in the relevant section;
3. 교량에서의 10분간 평균 풍속이 초당 25미터 이상인 경우(복층형 교량의 경우에는 상부교량에서의 10분간 평균 풍속이 초당 20미터 이상인 경우를 포함한다)
3. Where the 10-minute average wind speed on a bridge is 25 meters per second or more (including, for a double-deck bridge, where the 10-minute average wind speed on the upper bridge is 20 meters per second or more);
4. 안개 등으로 인하여 시계(視界)가 10미터 이하인 경우
4. Where visibility is 10 meters or less owing to fog or the like;
4의2. 지하차도의 침수 깊이 등이 국토교통부장관이 정하는 기준 이상인 경우
4-2. Where the flood depth or the like of an underpass is at or above the standards determined by the Minister of Land, Infrastructure and Transport;
5. 그 밖에 천재지변 또는 차량의 다중추돌, 위험물 누출을 동반한 대형교통사고 등으로 인하여 특정 지점의 교통이 마비되어 교통의 혼잡이나 정체가 현저하게 증가하거나 차량 통행의 위험이 현저하게 증가하는 경우
5. Other cases where traffic at a specific point is paralyzed owing to a natural disaster, a multi-vehicle collision, a major traffic accident involving leakage of hazardous materials, or the like, so that traffic congestion or jams markedly increase or the danger of vehicle traffic markedly increases.
② 도로관리청, 한국도로공사 또는 민자도로 관리자가 법 제76조제6항에 따라 긴급 통행제한을 실시하는 경우에는 지체 없이 다음 각 호의 사항을 적은 표지를 통행이 금지되거나 제한되는 구간의 양측과 그 밖에 필요한 장소에 설치하여야 한다.
(2) Where a road management authority, the Korea Expressway Corporation, or a private road manager implements an emergency traffic restriction under Article 76 (6) of the Act, it shall without delay install signs stating the following matters on both sides of the section where traffic is prohibited or restricted and at other necessary places:
1. 해당 도로의 종류ㆍ노선번호 및 노선명
1. The type, route number, and route name of the road;
2. 긴급 통행제한 구간 및 기간
2. The section and period of the emergency traffic restriction;
3. 긴급 통행제한의 대상
3. The subjects of the emergency traffic restriction;
4. 긴급 통행제한의 사유
4. The reasons for the emergency traffic restriction;
5. 그 밖에 긴급 통행제한에 필요한 사항
5. Other matters necessary for the emergency traffic restriction.
③ 법 제76조제6항에 따라 긴급 통행제한을 실시하는 경우 도로관리청, 한국도로공사 또는 민자도로 관리자는 관할 경찰관서의 장에게 제2항 각 호의 사항과 긴급 통행제한 원인의 발생 지점 및 시점, 교통통제 상황 등을 통보하여야 한다.
(3) Where an emergency traffic restriction is implemented under Article 76 (6) of the Act, the road management authority, the Korea Expressway Corporation, or the private road manager shall notify the head of the competent police station of the matters in the subparagraphs of paragraph (2), the point and time at which the cause of the emergency traffic restriction occurred, the status of traffic control, and the like.
